Debt review removal is a formal legal process through an attorney, available before a debt rearrangement court order when you can afford the original repayments. Your counsellor must prove affordability. The legal work has a fixed quoted fee. This is separate from promises to repair a credit score or erase a credit record.

After a court order, you must meet the clearance requirements and obtain Form 19. A listing where no application was made follows the NCR complaint route described below. Neither process guarantees new credit or a particular score.

How is legal debt review removal different from credit repair?

The legal process involves proving that you are no longer over-indebted before a debt rearrangement order has been granted. An attorney presents the case to court, with the debt counsellor’s affordability evidence. The court must accept that evidence; paying a fee does not secure a favourable decision.

A credit bureau cannot overturn a valid court order or approve your exit on affordability grounds. Ask what legal outcome the service seeks, who the attorney is and what evidence supports the application. A score-improvement promise does not answer those questions.

Start with the Debt Counselling guide if you are unsure how the formal process differs from an enquiry. The credit report guide helps you read the recorded status, but a report alone may not show the full case history.

Can I leave debt review before a court order?

The absence of a court order does not let you cancel a prescribed application by sending an informal instruction. The NCR’s March 2022 explanatory note confirms that voluntary withdrawal is not available merely because Form 17.2 has not been issued. Before a rearrangement order, a magistrate can consider evidence that you are not over-indebted. Your counsellor must complete a full budget and affordability assessment, and the attorney takes the supported application through the legal process.

You must afford the ORIGINAL contractual instalments, including relevant arrears, rather than only the reduced debt-review payment. On exit, agreements return to their original contractual terms. Ask for those amounts in writing. Supply current income proof, living expenses, statements and the requested case documents for a full affordability assessment.

The attorney must confirm that no debt rearrangement order exists and explain the proposed court steps. If the court still finds you over-indebted, debt review continues. Keep making the agreed payments while awaiting a decision.

What if my income improved after an order?

Once a debt rearrangement order is in place, improved income does not open this removal route. You must settle the qualifying debts and obtain a clearance certificate, with the exception for a qualifying remaining home loan. A higher salary can help you finish paying sooner, but it does not itself end the order.

Check the court documents before paying for removal. If an order exists, ask what remains to be paid and which confirmations are needed for Form 19. If you say you never applied, use the separate NCR complaint process below.

If your aim is faster completion, ask your counsellor how additional payments should be allocated and what creditor confirmations will be needed. Keep the payment trail intact. Do not change the arrangement or stop paying on an unverified assumption about cancellation.

When is clearance the appropriate route?

For consumers who meet the qualifying conditions, section 71 provides the clearance-certificate process. Read the Clearance Certificate guide for account evidence, the mortgage-related qualification and current filing steps. That route is different from trying to undo an existing order.

Ask for creditor confirmations and the certificate, followed by the submission reference and outcome. A payment-agency estimate is not the same as paid-up evidence. Where account figures differ, reconcile the dates and allocations before assuming everything is settled.

Check the resulting status on a free credit check. If the report remains inconsistent, keep the certificate and submission evidence for the follow-up. A report update does not guarantee a particular score or successful new credit application.

What is the fee for the formal legal process?

Formal debt review removal through an attorney has a fixed quoted fee for the agreed legal work. There is no single amount stated here for every firm or case. Many debt counsellors allow payment in instalments, with an agreed amount payable before the attorney is instructed to begin. Get the total, included work, any separately charged expenses and payment schedule in writing.

Before agreeing, ask for the attorney’s name, the steps to be taken, the evidence required and what happens to the fee if the matter cannot proceed. Ask the attorney to explain the fee terms and applicable rules. A fixed fee pays for the agreed service; it does not guarantee that you qualify or that the court will grant the application.

Keep this legal service distinct from a business promising to clean up your score or erase information without a legal basis. The NCR’s March 2025 debt review removal circular warns about misleading removal offers and explains the section 126A(3) restriction on payment before a covered credit-record improvement or removal service is fully performed. Describing a charge as a legal fee does not, by itself, establish an exemption. Require a written explanation of the actual legal work and charges rather than relying on the advert.

How do I prepare a useful exit assessment?

  1. Gather the application, notices, repayment plan and any court or Tribunal order.
  2. Obtain a current credit report and mark the status you are questioning.
  3. List all affected accounts with recent creditor balances.
  4. Add payment proof, agency statements and any paid-up letters.
  5. State whether you seek a before-order affordability assessment, clearance after repayment, or correction of a listing you say was made without an application.
  6. Request the proposed legal steps, the attorney’s identity, the fixed fee and payment schedule in writing.

Illustrative example: a consumer’s income improves. With no court order, the counsellor can assess affordability for the legal process through an attorney. With an order, the extra income can help repay debts faster towards clearance. Establish the case stage first.

The NCR guide explains registration and complaint checks. Use the DCD directory to locate counselling services and independently verify the named professional. For questions about orders, legal grounds or served papers, consult an attorney; the Law Society of South Africa provides general professional information.

What if I never applied for debt review?

If your credit report shows a debt-review flag but you say you never applied, lodge a complaint with the NCR through its official complaints channel. Keep the report, any messages and your complaint reference. Identify the counsellor shown on the record if you can, and explain why you dispute the application.

The NCR approaches the counsellor for clarification and evidence that you knowingly applied. This may include the signed Form 16 and, where relevant, a call recording or other application records. If the investigation establishes that no valid application was made, the record can be corrected with the NCR’s assistance. You can also raise an evidenced dispute with the bureau showing the incorrect entry; retain the NCR finding and all reference numbers.

Frequently asked questions

How much does it cost to get removed from debt review?

The formal attorney-led process has a fixed fee quoted for the agreed work; the amount is not the same for every provider. Ask for the total, any instalment arrangement and the amount payable before the attorney starts. Check what is included and remember that payment does not guarantee a successful application.

Can I pay my creditors directly while under debt review?

Do not switch the payment route without advice on your arrangement and the records required. A direct payment does not itself end debt review or undo an order. Ask your counsellor how any additional payment should be documented and allocated.

Can I remove debt review myself?

You can gather the case records and request an affordability assessment, but the formal removal route described here is handled through an attorney before a debt rearrangement court order. It requires proof that you can afford the original contractual instalments. If there is already an order, work towards clearance instead; if you never applied, use the NCR complaint route.

Can the NCR remove you from debt review?

For a listing you say arose without an application, lodge a complaint through the NCR’s official channels and identify the entry on your credit report. The NCR can investigate with the counsellor and help obtain correction where it finds that no valid application was made. This does not cancel a valid debt-review case simply because you want to borrow again.

Does stopping payment end debt review?

No: non-payment should not be treated as a lawful exit strategy. It can expose you to consequences under the arrangement and affect protection. Contact your counsellor urgently if you cannot afford the next instalment.
